Call to Order Chair Terry Jarvis called the meeting to order at 7:02 p.m. and led the Pledge of Allegiance. 2. Designated Authority Chair Jarvis said Interim Town Administrator Jeanie Forrester has left, and she wanted to make clear who had authority to do something before any new administrative person came in. She said TA Forrester contacted the Local Government Center to discover that, technically, any Board member can operate in that position of authority. She said the LGC asked about the hours the person would work and the pay received. Chair Jarvis said there is no pay involved for the time she has been working in Town Hall. She asked the Board who would carry on the day-to-day duties until the Board determines if it will hire a contract person or an administrative Town employee. Selectman David Bickford said the chairperson of the Board has always been the member in charge. Chair Jarvis asked if that included making routine decisions. Selectman Bickford said many towns dont even have town administrators. Selectman Fred March said he had previously brought up a time when Board members took on certain departments. He said here was an example of how that could come into play. He recalled when former Selectman JoAnn Heger had to step in for a period of time when former TA Bill Herman was out of town at a town administrators conference or some other reason. Selectman Bickford recalled that TA Herman was off on assignment by FEMA. Selectman March said Ms. Heger stepped in while TA Herman was gone. Chair Jarvis said TA Forrester often asked questions of the Board. She said the LGC indicated the Board member in charge must clearly communicate that any questions or discussions with other Board members are transpiring under the town administrators role. She said if she asked for one of their opinions on a matter, it would be while she was acting in an administrative position and not wearing her selectmans hat, so as not to violate regulations regarding posted selectmens meetings. She said she would make her role clear when she spoke with them. She said she did not mind taking on the duties for a short time with no pay, but she did have some things on her calendar. Selectman Bickford said she could his and Selectman Marchs help. Chair Jarvis said she had to go out of town in a couple of weeks and would need someone to come in to Town Hall if necessary. Selectman March asked when the Board would decide if it was going to hire a contract person or an employee. Chair Jarvis said Don Jutton of MRI was coming back. She said he submitted his proposal on Monday, March 29, 2010. She said she did not like the money attached to his proposals. She said the Board would decide on Monday, April 5, 2010. She said, then, depending on the decision, it was a question of how soon a new person would step in. Selectman March asked what Mr. Jutton was proposing for the time frame. Chair Jarvis replied it was a one-year contract that could be renewed. Selectman March asked what kind of numbers were in the proposal. Chair Jarvis indicated one proposal was for $45,000 from now until the end of the year, and the other was for $60,000. She indicated both Selectmen March and Bickford received copies of the proposals. Selectman March said he was still digesting all the other information. He said you would think MRIs year would run from election to election. Chair Jarvis said the contract would not be based on the fiscal year. She said MRI could have someone here by May 1, 2010, if not sooner. Selectman March asked if MRI provided guidelines or would use the Towns job description. Chair Jarvis said he presented a job description as part of his proposal, but the Board had the right to decide what it wanted. She said they should line things up the way they wanted them lined up. Chair Jarvis said someone needed to be in charge for the continuation of day-to-day business, and the staff needed a contact person. Motion by Selectman Bickford to authorize the chair to serve in the position of interim town administrator until the position is filled. Selectman Bickford said the administrator is a staff person who takes orders from the Board. Second by Selectman March. The motion carried unanimously. 3. Any Other Business Selectman March said he wanted to go into non-public session to discuss an employee. Chair Jarvis said she did not think that would be possible, as the meeting was posted to conduct business on the single entity of day-to-day business. No reference to enter non-public session was on the posting. Selectman Bickford said the Board did not even have to publish an agenda. Selectman March said it was not an emergency and it could be discussed at Mondays meeting. Selectman Bickford said the Board could discuss it now. Chair Jarvis said she did not feel comfortable doing so. Selectman Bickford said the Board can do other business. Chair Jarvis said she would ask the LGC if other business could be undertaken if the meeting was posted as a work session for specific matters or as a one-item discussion. She said she thought she recalled TA Forrester advising that specific things could not be done because the meeting was called as a work session. 4. Adjournment Motion by Selectman Bickford at 7:24 p.m. to adjourn; second by Selectman March. The motion carried unanimously. Respectfully submitted, Cathy L.
